Please read these Terms carefully. These Terms govern your use of KennMichAus.com. KennMichAus is a marketplace that connects users. Unless expressly stated otherwise, KennMichAus is not the provider of services offered by users and is not a party to agreements users make with one another.

1. Operator and Scope

These Terms of Use apply to the use of KennMichAus at kennmichaus.com.

These Terms apply to registered users and, where relevant, visitors who use publicly available platform features.

2. What KennMichAus Does

KennMichAus is a marketplace and connection platform. Users can offer or look for knowledge, practical experience, assistance and services in a variety of subject areas.

The platform may allow users to:

• create user profiles, including profile images and galleries;
• publish offers and requests;
• search for users, listings and topics;
• communicate through the internal messaging system;
• display voluntarily published business contact information where supported;
• save favorites;
• follow or block other users;
• receive in-platform and, where enabled, email notifications;
• submit and view reviews after contact has been initiated through the platform; and
• report profiles, offers, requests, messages or reviews.

KennMichAus generally does not perform the services offered by users and does not become a party to contracts or arrangements users make with one another.

3. Registration

Certain features require registration. Information requested during registration must be accurate and complete. Users must keep login credentials confidential and protect them from unauthorized access.

An account may be created only for yourself or for a business or organization you are authorized to represent. Impersonation, false identities and unauthorized use of another person's information are prohibited.

Email verification may be required before certain account functions become available.

Users may identify an account as individual or business. This designation is based primarily on information supplied by the user and is not a legal, tax, licensing or regulatory determination by KennMichAus.

3.1 Public Display of Names

For individual accounts, KennMichAus may display a user's name in abbreviated form in public areas, for example a first name and the initial of the last name. The full name provided to KennMichAus may remain stored in the account where needed for internal, contractual, security or legal purposes.

Business accounts may display a business, provider or personal name publicly. Business users are responsible for ensuring that names and business information they publish are accurate and that they have the right to use them.

3.2 Optional Public Contact Information

Business profiles may include optional fields for business contact information such as a phone number, email address or website. Users decide which supported contact details they make public.

Information made public may be visible to visitors who are not signed in and may allow visitors to call, email or visit an external website. Users must have the right to publish any contact information they provide.

4. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to create an account.

A business or other organization may use KennMichAus only through a person authorized to act on its behalf.

5. Account Security

Users are responsible for activity through their accounts to the extent that the activity is attributable to them. If you suspect unauthorized access, change your password promptly and notify KennMichAus.

KennMichAus may use reasonable technical safeguards against abuse, including temporary login restrictions following repeated failed login attempts.

6. Platform Fees

KennMichAus is currently generally free to use unless a particular feature is clearly identified as paid.

Free features are not guaranteed to remain free permanently. If paid features are introduced, the applicable price and material terms will be presented before a user purchases or subscribes to the paid feature.

7. User Offers

Users may publish offers describing their knowledge, experience, services, prices, locations and method of providing assistance.

The user publishing an offer is responsible for its accuracy, completeness and legality. Prices and other material terms must not be false or misleading.

KennMichAus does not generally verify that every user possesses every claimed qualification, license, permit, certification or professional authorization.

8. Requests

Users may publish requests to find assistance on a particular topic. The user publishing a request is responsible for the accuracy and legality of the information provided.

9. Agreements Between Users

Publishing an offer or request on KennMichAus does not by itself create a contract for the described service.

Users decide whether to enter into an agreement with one another and on what terms. Any agreement for services is between those users unless KennMichAus expressly states otherwise.

KennMichAus currently does not handle performance of those user-to-user services, payment processing, refunds or warranties for those services.

10. Prices, Payments and Taxes Between Users

If users agree on compensation for a service, pricing and payment are currently handled directly between the participating users.

KennMichAus currently does not collect or hold payments for user-to-user services.

Users are responsible for determining and complying with tax, licensing, registration, insurance and other legal requirements that apply to their activities, services or income under applicable federal, state and local law.

An account designation such as “individual” or “business” is not a legal or tax classification by KennMichAus.

KennMichAus does not provide legal, tax, accounting, licensing or insurance advice.

11. Permitted and Prohibited Content and Services

Only lawful content, requests and services may be posted or offered through KennMichAus.

Prohibited content or conduct includes:

• illegal or fraudulent offers, requests or activities;
• threatening, harassing, defamatory or unlawfully discriminatory content;
• content that infringes intellectual property, privacy, publicity or other rights;
• false identities, fabricated reviews or deceptive references;
• spam, automated mass messaging or misuse of the platform;
• services requiring a license, permit, certification or other authorization when the provider does not possess the required authorization; and
• services or activities prohibited by applicable law.

KennMichAus may restrict or prohibit categories that are highly regulated, unsafe or otherwise inappropriate for the platform.

12. Professional and Regulated Services

KennMichAus is primarily a platform for connecting people around knowledge, experience and practical assistance. It is not a substitute for appropriately licensed professional services.

Users must not provide professional services in violation of applicable licensing or professional-practice laws. This may include legal, medical, financial, tax, mental-health, construction, insurance or other regulated services depending on the jurisdiction and circumstances.

Users are responsible for determining whether a service requires a particular license, permit, certification or professional qualification.

13. Moderation

KennMichAus may review user content before or after publication. Content may be rejected, restricted, suspended or removed when we reasonably believe it violates these Terms, applicable law, third-party rights, platform safety requirements or other applicable platform policies.

Edited content may be reviewed again before becoming publicly visible.

14. Reporting Content

Users may report potentially unlawful, abusive or otherwise problematic content through available reporting functions or by contacting KennMichAus.

A report does not automatically result in removal. Knowingly false or abusive reports are prohibited.

15. Reviews

Reviews are intended to help users understand genuine experiences. KennMichAus may technically require that users have communicated through the platform before a review can be submitted. That requirement does not confirm that a paid transaction occurred or that a service was completed.

Reviews must reflect the reviewer's genuine experience and must not be fabricated, manipulated, unlawfully threatening or submitted solely to improperly harm or inflate a profile.

KennMichAus may moderate or remove reviews that violate these Terms, applicable law or platform policies. Nothing in these Terms is intended to prohibit users from providing honest reviews or opinions protected by applicable law.

16. Messages and Communications

The internal messaging system may be used only for lawful communications related to use of KennMichAus.

Spam, unrelated unsolicited advertising, harassment, threats, scams and unlawful content are prohibited.

Users may block other users. Blocking may restrict direct communication and following or end existing follow relationships.

17. Notifications

KennMichAus may provide account notifications concerning messages, followers, reviews, moderation decisions and other platform activity.

Where settings are available, users may be able to enable or disable certain email notifications. Necessary security, account or service communications may still be sent when appropriate.

18. User Content and License to KennMichAus

You may upload or publish only content that you own or otherwise have the rights and permissions necessary to use and share.

By uploading or publishing content, you grant KennMichAus a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, resize, compress and technically adapt that content solely as reasonably necessary to operate, secure, promote the relevant listing or profile within the platform, and provide KennMichAus features.

You retain ownership of your user content. The license generally ends when the relevant content is deleted, except to the extent continued retention is reasonably necessary for backups, security, legal compliance, dispute resolution or other lawful purposes.

19. Duration of Offers and Requests

Published offers and requests are generally stored for a maximum of eight weeks from creation and may then be automatically deleted.

KennMichAus may later offer expiration reminders or republishing options, but users are not guaranteed those features.

20. Platform Availability

We aim to keep KennMichAus available and reliable, but uninterrupted or error-free availability is not guaranteed.

Temporary interruptions may result from maintenance, technical failures, security measures, system changes, third-party services or events outside our reasonable control.

21. Platform Changes

KennMichAus may add, change, limit or discontinue features. Where a change affects a paid service, any rights that cannot lawfully be waived remain unaffected.

There is no guarantee that free features will remain available indefinitely or in their current form.

22. Suspension and Account Termination

Users may request account deletion, subject to information we may need to retain for security, dispute resolution, legal compliance or other lawful purposes.

KennMichAus may restrict, suspend or close an account for material or repeated violations of these Terms, applicable law, third-party rights or platform safety requirements.

Serious violations may result in immediate action where reasonably necessary to protect users, the platform or others.

23. User Responsibility and Safety

Users decide whom to contact and whether to enter into an agreement with another user.

Before meeting someone in person, making a payment or sharing sensitive information, users should take reasonable steps to evaluate the other person's identity, qualifications and trustworthiness.

KennMichAus does not guarantee that user-provided information is complete, current or accurate, or that another user will perform a service at all or to a particular standard.

24. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KENNMICHAUS.COM AND ITS PLATFORM FEATURES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

KENNMICHAUS DOES NOT WARRANT THAT USER CONTENT, USER QUALIFICATIONS, LISTINGS, SERVICES OR OTHER INFORMATION PROVIDED BY USERS IS ACCURATE, COMPLETE, SAFE, LEGAL, AVAILABLE OR SUITABLE FOR A PARTICULAR PURPOSE.

Nothing in these Terms excludes warranties, guarantees, remedies or other rights that cannot lawfully be excluded or limited.

25. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THOMAS WIELE GMBH AND KENNMICHAUS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM OR DEALINGS WITH OTHER USERS.

KENNMICHAUS IS NOT RESPONSIBLE FOR THE ACTS, OMISSIONS, CONTENT OR SERVICES OF OTHER USERS EXCEPT TO THE EXTENT RESPONSIBILITY CANNOT LAWFULLY BE EXCLUDED.

THE LIMITATIONS IN THESE TERMS APPLY ONLY TO THE EXTENT PERMITTED BY THE LAW THAT APPLIES TO YOU. SOME STATES DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

26. Indemnification

To the extent permitted by applicable law, if your unlawful conduct, user content or services cause a third party to bring a claim against Thomas Wiele GmbH or KennMichAus, you agree to be responsible for losses, liabilities and reasonable defense costs resulting from that claim to the extent caused by your violation of these Terms, applicable law or third-party rights.

This section does not apply to the extent prohibited by applicable consumer-protection law.

27. Privacy

Information about how we collect, use and disclose personal information is available in our Privacy Policy.

28. Changes to These Terms

We may update these Terms when reasonably necessary because of changes to the platform, our business, applicable law or security requirements.

If a change is material, we may provide additional notice where appropriate or required by law. Changes will apply prospectively from their stated effective date. Where affirmative consent is legally required, we will request it.

29. Governing Law and Consumer Rights

Because KennMichAus.com is operated by Thomas Wiele GmbH in Germany while serving users in the United States, questions about governing law and jurisdiction can depend on the user's location and the nature of the dispute.

To the extent legally permitted, these Terms and the relationship between KennMichAus and the user are governed by the laws of Germany, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods.

However, this choice of law does not deprive a consumer of mandatory rights or protections that apply and cannot lawfully be waived under applicable U.S. federal, state or local law or other applicable law.

30. No Mandatory Arbitration Clause

These Terms do not currently require users to resolve disputes through mandatory arbitration and do not contain a class-action waiver. If KennMichAus introduces a dispute-resolution provision in the future, it will be presented in accordance with applicable law.

31. Severability

If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. An unenforceable provision will be interpreted or limited only to the extent necessary to make it enforceable where legally permitted.

32. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly presented for a particular feature, constitute the agreement governing use of KennMichAus.com between you and Thomas Wiele GmbH with respect to the platform.
